Animal Insights Client Agreement

Agreement between: Marketwise Insights, Inc. d/b/a Animal Insights, d/b/a Carol Monaco and ______­­­­­­­­­___ (“Client” or “you”) whereby AI/Carol Monaco agrees to provide certain services described herein for the Client.  For and in consideration of the services you will receive from AI/Carol Monaco (“Services”), you hereby agree to the following terms and conditions on behalf of yourself, your estate, heirs and assigns:

Description: By clicking “I agree” and registering for an appointment or other service offerings you are agreeing to the following terms related to the Services.  You must make any cancellations at least 48-hours prior to the scheduled appointment.  Any cancellations made less than 48-hours before the meeting other than due to documented illness will incur a half fee.  AI reserves the right to make exceptions to this policy which do not indicate any future change in policy.  All sessions must be used within 12 months of purchase.  Any exceptions to this policy are at AI’s discretion and do not indicate a future change in policy. Any unused sessions after such time frame shall expire and no refunds will be available.  Payment is due when scheduling the session or service offerings (though payment plans may be available for larger offerings), and full payment is required regardless of whether you have chosen to end the session early or the session is otherwise shortened due to late arrival, or otherwise.

Release and Waiver: By Clicking “I Agree,” you agree to the following:

1. You understand that AI is providing advice and information based on the information you give to AI, and AI’s own knowledge and skillset.  You acknowledge that AI, and persons working for AI, are not a veterinarian, nor do they hold certifications of being a licensed or certified professional dog trainer, certified pharmacy technician, OSHA safety certified or Red Cross pet first aid certification. You are fully responsible for your and your pet’s physical, mental, and emotional well-being during the Services, including your choices and decisions. You are also advised to consult with a veterinarian or other trained professional related to any physical, mental or emotional issues with your pet.  The Services offered by AI are meant to complement other approaches, and not to replace them.  You understand that AI Services are not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and you will not use it in place of any form of diagnosis, treatment, or therapy.

2. You affirm that all personal information about you and/or your companion animal (including horses and farm animals) provided on questionnaires is truthful and accurate to the best of your knowledge, and you will not hold AI responsible or liable for any injury, illness or death caused by your failure to disclose a known medical or mental health condition of you or your animal. You understand that information will be held as confidential unless you state otherwise, in writing, except as required by law.   

3. You understand that AI Services are not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals. You will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters. You understand that all decisions in these areas are exclusively yours and acknowledge that your decisions and actions regarding them are your sole responsibility.

4. By clicking “I agree,” you agree on behalf of yourself, your heirs and assigns to waive, release, not sue, discharge, save, indemnify, and hold harmless AI and AI’s owners, employees, agents and affiliates (“Released Parties”) of and from all claims, demands, causes of action, lawsuits and damages by me, my estate, my family (including minor children), heirs, or others who may have a claim for my or my animal’s injury, illness or death as a result of any act or failure to act, including negligence by AI, associated with utilizing the Services. I agree that my or my estate shall be fully liable (pay for) for the cost to the Released Parties for any claim brought on my behalf as a consequence of my participation in the Services.

7. This is a legal contract and you are signing it without duress or further inducement. You understand this is an unconditional and complete release of all liability to the greatest extent allowed by law. If any portion of this Agreement is found to be legally unenforceable or invalid, that portion shall be severed, and the remainder shall have full force and effect. You agree to be bound by this letter without modification of the preprinted text. This letter shall be governed by the law of the State of Colorado without regard to conflict of law principals.  Any and all action, litigation, mediation or other dispute shall be solely brought in the courts of the State of Colorado.  In the event of any litigation or dispute, the prevailing party shall be entitled to have all fees, costs and expenses (including reasonable attorney’s fees) paid by the non-prevailing party.

Please click I agree to indicate your acceptance of this Agreement, which shall be treated as a signature and create a binding contract between you and AI.  This contract may be executed electronically and in counterparts.
